Terms of Service

Article 1 (Purpose)

These Terms set out the conditions and procedures for using the web game MOMOKOO MERGE (the “Game”) provided by N.O.S (the “Operator”), together with the rights, obligations and responsibilities of the Operator and users.

Article 2 (Definitions)

1. Game: MOMOKOO MERGE and all related services provided by the Operator in web and app form.
2. User: a person who uses the Game under these Terms.
3. Player ID: a random string generated automatically on the user's device to identify ranking records. There is no sign-up and no account. The value stays the same whether or not the user enters a display name. A user can view their own Player ID in the Game under Pause → Name settings.
4. Display name: the name shown on the ranking screen, either entered by the user or generated automatically.

Article 3 (Effect and Amendment of these Terms)

1. These Terms take effect when posted within the Game or on the Game's website.
2. The Operator may amend these Terms to the extent that doing so does not violate applicable law.
3. Where these Terms are amended, the Operator will post the changes and the effective date within the Game or on the website from 7 days before that date. For changes unfavourable to users, the notice period is 30 days.
4. Continuing to use the Game after the effective date of an amendment is treated as acceptance of it. A user who does not accept the amendment may stop using the Game.

Article 4 (Scope of the Service)

1. The Operator provides the following free of charge:
   • gameplay features;
   • score recording and the global ranking;
   • saving and sharing an image of the game result;
   • any other feature the Operator adds.
2. The app versions of the Game include a support item, offered so that players may support its creation. Supporting is entirely optional; every feature of the Game remains equally available without it, and supporting confers no advantage within the Game.
   • Apps (Google Play · App Store) — payment is processed through each store's own payment system. Payment method details are handled by that store; the Operator neither collects nor retains them. Receipts, refunds and payment enquiries follow each store's policies and procedures.
   • Web and itch.io — the support button opens an external support site, and any payment made there is governed by that site's policies. No paid item is offered inside the Game itself.

Article 5 (Change and Suspension of the Service)

1. The Operator may change the content of the service, the game rules, the balance, the screen layout and similar matters where operationally or technically necessary.
2. The Operator may suspend all or part of the service without prior notice in any of the following cases:
   • system inspection, maintenance, replacement or failure;
   • failure or suspension of an external service the Operator relies on (hosting, database and the like);
   • force majeure such as natural disaster or national emergency.
3. The Operator may discontinue the service itself, in which case notice will be posted within the Game or on the website at least 30 days before the closing date.
4. The Operator is not liable for loss arising from the change, suspension or discontinuation of a service provided free of charge, except where the Operator has acted with intent or gross negligence.

Article 6 (Player ID and Retention of Records)

1. The Game has no sign-up procedure and identifies ranking records by the Player ID stored on the user's device.
2. The Player ID, display name, best score and game settings are stored in the user's browser storage (localStorage).
3. In the following cases a user's records and settings cannot be recovered. Users should be fully aware of this before playing:
   • browser data, cookies or site data are cleared;
   • the Game is played in private / incognito mode;
   • the Game is opened on a different device or a different browser;
   • the app is deleted and reinstalled.
4. The Operator does not provide transfer or recovery of records following a change of device or deletion of data.

Article 7 (User Obligations)

Users must not do any of the following.

1. Obtain or submit scores other than through normal play — including modifying the game client, network traffic or stored data, or using automation such as macros or bots.
2. Place an excessive load on the game server or ranking system, or otherwise interfere with normal operation.
3. Use a display name containing:
   • profanity, abusive language, or hateful or discriminatory expression;
   • obscene or violent expression;
   • expression that defames or insults another person;
   • impersonation of another person, or of the Operator or its administrators;
   • advertising, promotion or other commercial content.
4. Copy, distribute or reverse-engineer the Game's source code or assets (images, audio and the like) without authorisation, or create and distribute derivative works from them.
5. Otherwise breach applicable law or these Terms.

Article 8 (Deletion of Records and Restriction of Use)

1. Where the Operator judges that a user has breached Article 7, it may take the following measures without prior notice:
   • exclude the score from the ranking, or delete it;
   • change or delete an inappropriate display name;
   • bar the Player ID concerned from submitting to the ranking;
   • restrict use of the service in whole or in part.
2. The Operator may run automated server-side validation to judge whether a score is legitimate, and a record that is difficult to achieve through ordinary play may be refused.
3. A user who objects to a measure under paragraph 1 may raise it through the contact point in Article 12. The Operator will lift the measure where it accepts that the objection is justified.

Article 9 (Intellectual Property)

1. Rights in all works contained in the Game — characters, images, audio, text, programs, trade marks and designs — belong to the Operator or to the rightful rights holder.
2. Users may not reproduce, transmit, publish, distribute, broadcast or commercially exploit the works in paragraph 1 without the Operator's prior consent.
3. However, users may freely share, for personal and non-commercial purposes, images created through the Game's own save and share result image feature.

Article 10 (Disclaimer)

1. The Operator accepts no liability in connection with a service provided free of charge, except where applicable law provides otherwise.
2. The Operator is not liable for loss arising from the following, except where the Operator has acted with intent or gross negligence:
   • problems originating in the user's device, network environment or browser settings;
   • loss of records caused by the user clearing browser data themselves;
   • failure of an external service (hosting, database, social media and the like);
   • disputes between users, or between a user and a third party.
3. The Operator is not liable for a user's failure to achieve an expected score, rank or result in the Game.

Article 11 (Protection of Personal Information)

The Operator collects only the minimum information necessary to provide the Game. Details are governed by the separate Privacy Policy.

Article 13 (Governing Law and Dispute Resolution)

1. These Terms and use of the Game are governed by the laws of the Republic of Korea.
2. Where a dispute arises between the Operator and a user in connection with use of the Game, both parties will endeavour to resolve it amicably by mutual discussion.
3. If discussion does not succeed and proceedings are brought, they shall be brought before the court having jurisdiction under the Korean Civil Procedure Act.
